India has officially implemented four new labour codes as of 21 November 2025. These changes are part of a massive reform aimed at simplifying the country’s complex labour laws, modernising the system, and ensuring greater protections for workers across industries. The labour codes will impact various sectors, from gig workers to formal sector employees, and will also help businesses streamline their operations.

Key Changes in the Labour Laws

India’s four new labour codes are designed to replace 29 previous laws and are divided into the following categories:

  1. The Code on Wages:

    • Ensures a minimum wage for workers in all sectors, including gig workers.

    • Wage Equality: The new code makes sure that all workers, irrespective of their sector, receive equal pay for equal work.

  2. The Industrial Relations Code:

    • Simplifies the process for businesses to hire and lay off workers, with a focus on ensuring that workers receive fair compensation.

    • Streamlines trade union procedures and ensures smooth dispute resolution between workers and employers.

  3. The Code on Social Security:

    • Extends social security benefits to workers in the gig economy and those in unorganised sectors like domestic workers, agricultural workers, and casual workers.

    • Guarantees health insurance, maternity benefits, and retirement pensions.

  4. The Occupational Safety, Health and Working Conditions Code (OSHWC):

    • Sets higher safety standards in workplaces, especially for sectors like construction, mining, and hazardous industries.

    • Mandates that employers provide a safe working environment and take steps to ensure worker well-being.

What Does This Mean for Workers and Businesses?

For Workers:

  • Better Job Security: Workers in fixed-term contracts will now be eligible for benefits like gratuity after just one year of service, instead of the earlier requirement of five years.

  • Gig Worker Protections: The gig economy is now officially recognised, ensuring gig workers get social security benefits and protection under labour laws.

  • Maternity & Equal Pay: Women workers are entitled to extended maternity leave and equal pay for equal work in the same role across all sectors.

For Businesses:

  • Simplified Compliance: The new codes will make it easier for businesses to comply with labour laws, reducing red tape and streamlining processes.

  • Flexibility in Hiring: Companies will have more flexibility in hiring and firing workers. They will be able to hire workers on fixed-term contracts without needing government approval for layoffs for businesses with fewer than 300 employees.

  • Increased Responsibility: With greater worker protections, employers will need to ensure their operations align with the new codes, including ensuring workers' health and safety.

Why the Reform Matters Now

  • The old labour laws were outdated, and India’s economy, especially the gig economy, has changed drastically in recent years. These new codes are a much-needed update to reflect modern work conditions.

  • By simplifying and streamlining the system, these laws also aim to boost India’s business environment, attracting more foreign investment and improving ease of doing business.

  • For workers, especially those in informal sectors or gig-based jobs, these reforms provide a new safety net, ensuring that they can access social security and health benefits previously unavailable to them.

What to Expect Moving Forward

  • While these changes will bring greater equity and safety for workers, they also require businesses to adapt quickly to comply with the new codes.

  • Workers and employers must stay informed and understand their rights and responsibilities under these new laws to avoid any legal complications.

  • Trade unions have raised concerns that these changes might favour employers in some cases, especially around worker rights during layoffs and contract changes. This debate will likely continue in the coming months.
