In a recent development, the Supreme Court of India has granted a six-month extension to low-cost airline SpiceJet Ltd for settling its $3-million arrears owed to Credit Suisse. The apex court has directed SpiceJet to make monthly payments of $1 million for the next six months to resolve the dispute over unpaid dues.
A spokesperson for SpiceJet expressed gratitude for the Supreme Court's understanding and stated, "Supreme Court has noted our compliance with its previous orders and agreed with our proposal to pay the $3 million arrears over the next 6 months. This is a positive outcome for the company and our stakeholders, and we are grateful to the Court for its understanding. We are committed to paying our dues in full and on time. We remain fully committed to upholding the highest standards of compliance and look forward to continuing our positive engagement with all stakeholders."
Following this announcement, SpiceJet's stock on the Bombay Stock Exchange (BSE) experienced a 1.5% decrease, closing at Rs 36.48 on Friday.
This decision comes after the Supreme Court issued a warning to SpiceJet earlier in the month, cautioning the airline about facing "drastic action" if it failed to settle its outstanding dues to Credit Suisse.
The legal dispute between Credit Suisse and SpiceJet dates back to 2015, with Credit Suisse asserting that the airline owed approximately $24 million in unpaid dues. This contentious issue eventually led to a significant development in 2021 when the Madras High Court ordered the liquidation of SpiceJet.
The ruling by the Madras High Court marked a critical juncture in the ongoing legal battle, as it appeared to bring the airline's operations to a potentially dire end. However, SpiceJet subsequently appealed the decision, seeking relief and an opportunity to resolve the financial dispute amicably.
The recent extension granted by the Supreme Court provides a lifeline for SpiceJet, allowing the airline an additional six months to make substantial payments towards settling its arrears with Credit Suisse. This respite will likely be instrumental in the company's efforts to avoid liquidation and secure its future in the Indian aviation industry.
The case underscores the complexities and challenges faced by businesses in managing financial obligations, particularly in the wake of the global economic disruptions caused by the COVID-19 pandemic. SpiceJet's ongoing commitment to compliance and its dedication to meeting its financial obligations will be closely monitored as it navigates this critical phase in its legal and financial journey.
As the aviation industry continues to grapple with the aftermath of the pandemic, the outcome of this dispute and SpiceJet's ability to clear its outstanding debts will be of keen interest to stakeholders, investors, and the broader business community. The extension provided by the Supreme Court offers a ray of hope for SpiceJet's future, albeit contingent on the airline's ability to meet its payment commitments in the coming months.
